1. THE TREEMAP Information

2. Description of Services
2.1 Services
The TreeMap has designed and developed Nusantara Atlas (the “Platform”), a web application enabling users (“You” or “Users”) to monitor deforestation, wildfires, peatland degradation, and forest regeneration across Equatorial Asia (Brunei, Indonesia, Malaysia, and Papua New Guinea) as well as Colombia. Key Features of the Platform include:
- Interactive Web Mapping: Enables users to explore forest loss, plantation expansion, and other land cover changes across the five covered countries with maps and infographics.
- Satellite Data Integration: Provides visual access to satellite imagery allowing historical and real-time verification of land-use changes.
- Deforestation & Fire Monitoring: Tracks annual deforestation and plantation expansion trends, along with near real-time deforestation and fire alerts.
- Cadastral & Administrative Data: Offers a rich dataset of cadastral information, including concessions, administrative boundaries, and land tenure data, to provide context for deforestation analysis.
- Time-Lapse Satellite Animations: Generates satellite time-lapse animations, enabling users to visualize landscape changes over time.
- Automated Reporting: Generates deforestation reports based on available platform data (the “Reports”), offering insights into deforestation dynamics in your chosen land plots.

You have access to the Platform as part of the subscription that your employer (the “Company”) has taken out with THE TREEMAP, enabling you to benefit from the Services.
The Services subscribed to by the Company and to which you have access are described on the Platform. The present terms and conditions of use (the “Terms and Conditions”) grant the User, a natural person with full legal capacity, a personal and non-exclusive license to use the Platform. They can be found via a direct link on the Platform.
In the event of any contradiction between the Terms and Conditions and the conditions negotiated with the Company as part of its subscription, the provisions of the contract concluded with the Company shall prevail.
2.2 Additional Services
2.2.1 Maintenance
For the duration of the Services, you benefit from maintenance, in particular corrective and ongoing maintenance. In this context, access to the Platform may be limited or suspended.
THE TREEMAP makes every effort to provide you with corrective maintenance to correct any malfunction or bug found on the Platform.
You also benefit from ongoing maintenance, which THE TREEMAP may carry out automatically and without prior notice, and which includes improvements to the Platform’s functionalities, the addition of new functionalities and/or technical installations used within the framework of the Platform (aiming to introduce minor or major extensions).
Access to the Platform may also be limited or suspended for planned maintenance purposes, which may include the corrective and ongoing maintenance operations referred to above.
2.2.2 Hosting
THE TREEMAP uses its best efforts to host the Platform, as well as the data produced and/or entered by/on the Platform, via a professional hosting service provider, and on servers located in a territory of the European Union.
2.2.3 Technical support
In the event of any difficulty encountered while using our Services, you may contact THE TREEMAP using contact details provided in article “THE TREEMAP information”.
Technical support service is available from Monday to Friday, excluding public holidays, from 9 am to 6 pm. Depending on the need identified, THE TREEMAP will estimate the response time and inform you accordingly.
3. Access to the Platform and Acceptance of the Terms and Conditions
You may access our Services provided that you are an employee of the Company.
You can access our Services by clicking on the invitation link we sent to you by email, which will redirect you to the Platform user account creation page (the “Account”) on which you can create one using your email address.
You must provide us with all the information marked as mandatory, then you are invited to accept the Terms and Conditions by checking a box on your form. You agree to the Terms and Conditions by checking a box at your first connection to the Platform. If you do not agree to all of the Terms and Conditions, you may not access the Platform.
4. Duration of the Services
You can use our Services for the duration subscribed by the Company as part of its subscription contracted with THE TREEMAP.
However, your Account may be deactivated at any time:
- At the request of the Company,
- If the Company terminates its contract with THE TREEMAP, the Account will be automatically deactivated, and the User will no longer be able to access the Services,
- If you send us a request to this effect to the e-mail address specified in the article “THE TREEMAP information”.
As an exception to the foregoing, you may continue to use the Services by taking out a free subscription directly with us via the appropriate function on the Platform.
5. Intellectual Property Rights
5.1 Intellectual property rights on the Platform
The Platform are THE TREEMAP’s property, as are THE TREEMAP’s software infrastructures, databases and content of any kind (texts, images, visuals, music, logos, brands, etc.). They are protected by all intellectual property rights or database producers’ rights in force. The license granted to the User does not entail any transfer of ownership.
You are granted a non-exclusive, personal and non-transferable license to use the Platform in SaaS mode for the duration specified in article “Duration of the Services”.
Apart from the rights granted under this license, you are not authorized to:
- Copy, print, transfer, transmit or display all or part of the Platform.
- Assign, lease, sublicense or otherwise distribute your rights to use the Platform to any third party.
- Use the Platform to provide data processing or similar services of any kind to any third party.
- Modify and/or improve the Platform, compile, decompile, disassemble, translate, analyze, reverse engineer or attempt to do any of the foregoing, except to the extent permitted by law.
- Reproduce any part of the Platform code, by any means whatsoever, in any form whatsoever and on any medium whatsoever.
- Develop, have developed or market software solutions or products likely to compete with the Platform during the term of the Services.
Throughout the Platform, you may access geographic content and data including, but not limited to, maps, cadasters and geographic data concerning the countries covered by the Platform, dashboards highlighting deforestation alerts as well as public supply chain links (refineries, crushers, mills and plantations) (the “Materials”) either:
- Developed, derived and made available by THE TREEMAP which includes maps derived from satellites and mill location map (“TTM Materials“), or
- Belonging to or originating from third parties (such as governments and NGO sources, and media reports) and aggregated on the Platform which includes concession, land use plan, protected area, administrative boundary maps (“Third Party Materials”).
You may download, copy, reproduce, republish, modify, post, broadcast, transmit, distribute, make available to the public, or otherwise use TTM Materials in any way, provided that you:
- Clearly attribute the work and any identified source.
- Provide a link to the Platform.
- Use the TTM Materials for non-commercial, research, educational or personal purposes.
In the case of downloads, screenshots, GIFs or Shapefile downloads of Materials including Third-Party Materials, your use of such Third-Party Materials is governed solely by the terms of use of the third party from which the Third-Party Materials originated. In such cases, certain restrictions on the reproduction of content or graphic elements may apply, and it may be necessary to request authorization from the rights holder before reproducing the Third-Party Materials. To obtain information concerning copyright ownership and reproduction restrictions on the Platform, you may consult a page on the Platform referring to the conditions applicable to said Third Party Materials and, pending the setting up of said page by THE TREEMAP, you may contact THE TREEMAP at the following address: d.gaveau@THE TREEMAP.com.
Third Party Materials are outside the control and responsibility of THE TREEMAP which is only providing access to them. No sponsorship or endorsement by THE TREEMAP is therefore hereby implied.
5.2 Intellectual property rights on the Reports
While performing the Services, THE TREEMAP shall create Reports that may be protected by copyright. As such, the Reports constitute THE TREEMAP’s knowledge, of which THE TREEMAP retains the exclusive property and are therefore protected by all intellectual property rights. THE TREEMAP retains ownership of these Reports, which are granted to the User for a non-exclusive, non-transferable license to use for the duration of the Services, worldwide and for non-commercial, research, and internal purposes.
The User agrees not to copy, reproduce or duplicate in whole or in part the Reports when such copies, reproductions or duplications are not for their own use in connection herewith or that they have not expressly been authorized in writing by THE TREEMAP. The User is also prohibited from disclosing the Reports, either directly or indirectly, to any third party or to any person other than the Company and Users.
5.3 Ownership of User data
The User is the sole owner of the rights to the data processed under the Platform (the “Data”), unless otherwise specifically agreed between the THE TREEMAP and the Company.
The User grants THE TREEMAP and its subcontractors a non-exclusive, worldwide, free and transferable license to host, copy and display said Data for the sole purpose of executing the Services and exclusively in association with or in connection with it. This license will automatically terminate at the end of the Services, unless it is necessary to continue hosting and processing the Data, in particular as part of the implementation of reversibility operations or in the event of the User subscribing directly to the Platform from THE TREEMAP.
6. User’s Obligations and Liability
6.1 Concerning the User’s Account
You are responsible for maintaining the confidentiality and security of you login and password. Any access to the Platform using your login and password is deemed to have been made by you.
You must immediately contact THE TREEMAP using the contact details provided in article ” THE TREEMAP information” if you find that your Account has been used without your knowledge. You acknowledge that THE TREEMAP shall have the right to take all appropriate measures in such a case.
6.2 Concerning the use of the Services
You are responsible for your use of the Services and for any information you share in this context. You agree to use the Services personally and not to allow any third party to use them in your place or on your behalf.
You warrant THE TREEMAP against any misuse, non-compliant or illicit use of the Platform, including against any breach of the laws and regulations in force.
You undertake not to use the Services for purposes other than those for which they were designed, and in particular to:
- Engage any illegal or fraudulent activity.
- Undermine public order and morality.
- Infringe the rights of third parties in any way whatsoever.
- Violate any contractual, legislative or regulatory provision.
- Engage in any activity likely to interfere with a third party’s computer system, in particular for the purpose of violating its integrity or security.
- Promote your services and/or websites or those of a third party.
- Assist or incite a third party to commit one or more of the acts or activities listed above.
You also refrain from:
- Copying, modifying or misappropriating any element belonging to THE TREEMAP or any concepts we exploit within the framework of the Services.
- Engaging in any behavior likely to interfere with or hijack THE TREEMAP’s computer systems or undermine its computer security measures.
- Infringing THE TREEMAP’s financial, commercial or moral rights and interests.
- Marketing, transferring or otherwise giving access in any way whatsoever to the Services, to information hosted on the Platform or to any element belonging to THE TREEMAP.
- Using the Services outside the scope of the contractual relationship between THE TREEMAP and the Company.
You are responsible for the Data of any kind that you publish as part of the Services. You agree not to distribute any Data (this list is not exhaustive):
- Infringing public order and morality (pornographic, obscene, indecent, shocking or unsuitable for a family audience, defamatory, abusive, violent, racist, xenophobic or revisionist).
- Infringing the rights of third parties (counterfeit content, infringement of personality rights, etc.) and more generally violating a contractual, legislative or regulatory provision.
- Prejudicial to third parties in any way whatsoever.
- Misleading, deceptive or proposing or promoting illicit, fraudulent or deceptive activities.
- Harmful to the computer systems of third parties.
7. THE TREEMAP’s Obligations and Liability
THE TREEMAP undertakes to provide the Services with diligence, it being specified that we are bound by a best-effort obligation.
THE TREEMAP uses its best effort to provide the User with quality Services as indicated in the contract with the Company. In particular, THE TREEMAP undertakes to comply with all the provisions set out in the Company contract relating to maintenance and assistance of Users on the Platform.
THE TREEMAP reserves the right to temporarily interrupt access to the Platform for corrective maintenance purposes, to correct any malfunction or bug reported by the User.
Similarly, THE TREEMAP cannot be held responsible for temporary difficulties or impossibilities in accessing the Platform due to circumstances beyond THE TREEMAP’s control, force majeure, or due to disruptions in the IT environment of the Company.
Damages resulting from contractual breaches on THE TREEMAP’s part will be dealt with in the contract between the Company and THE TREEMAP. However, THE TREEMAP’s liability for personal injury suffered by the User is expressly limited to the amount of the price paid by the Company during the 12 months prior to the time the alleged damages occurred.
THE TREEMAP does not guarantee the Users that the Services, which are subject to constant research in order to improve their performance and progress, will be totally free of errors, defects or faults, and that the Services, being standard and in no way offered solely for the benefit of a given client according to your own personal constraints, will specifically meet your needs and expectations.
Information, images, maps and data on the Platform are provided on an “as is” basis. THE TREEMAP makes every effort to ensure, but makes no warranties, either express or implied, as to the accuracy, reliability, timeliness, merchantability and fitness for a particular purpose of any of the Materials.
8. Personal Data Processing
As part of the Services, THE TREEMAP may processes User’s personal data on behalf of the Company as a sub-processor, while the Company acts as a data controller in accordance with the applicable data protection regulations.
If the User has any questions about the processing of its personal data, please contact the Company.
9. Force Majeure
THE TREEMAP shall not be liable for any failure or delay in the performance of its contractual obligations due to force majeure occurring during the term of its relationship with the Company as defined in article 1218 of the French Civil Code.
If THE TREEMAP is prevented from fulfilling its obligations due to force majeure, it must inform the Company by registered letter with acknowledgement of receipt. Obligations will be suspended on receipt of the letter and must be resumed within a reasonable time once the force majeure has ceased. THE TREEMAP nevertheless remains bound by the performance of obligations not affected by force majeure.
10. End of Services
As the Company is responsible for creating access to User’s Accounts, you need to send a request to this effect to the Company to unsubscribe from THE TREEMAP’s Services.
You will then no longer have access to your Account or to the Services.
11. Sanctions in the Event of Breach
The obligations set out in the article ” User’s obligations and liability” are essential obligations.
If the User fails to comply with the following obligations, THE TREEMAP may suspend or cancel access to the Services and/or take any legal action.
These sanctions are without prejudice to any damages that THE TREEMAP may claim from the User.
12. Modification of the Terms and Conditions
THE TREEMAP may modify its Terms and Conditions at any time and will inform the User by any written means (and in particular by email).
Modified Terms and Conditions are applicable as soon as they come into force.
If you do not accept these modifications, you must stop using the Services and unsubscribe from the Services in accordance with article “End of Services”.
If the User uses the Services after the entry into force of the modified Terms and Conditions, THE TREEMAP considers that the User has accepted them.
13. Applicable Law
The Terms and Conditions are governed by French law.
